JELLYRIDE PRIVACY POLICY

1. Introduction

Welcome to JellyRide, a platform service that helps its users to organize and manage their individual or joint team activities that require itinerary planning, time scheduling, geo-coordination, and statistics about their activity. Additionally, JellyRide also enables its users to communicate and share information and media in real-time. JellyRide (“we”, “us”) is the data controller for the purpose of the GDPR and other relevant laws. We are committed to protecting and respecting your privacy. This Privacy Policy (together with our Terms of Service for Private Users (non-commercial use), Terms of Service for Business Users (commercial use), and any other documents referred to in it) applies to the JellyRide Platform that consists of the mobile application (the “Application”), the web application (the “Web”), the related backend infrastructure (the „Backend Services“) and respective informative landing page located at JellyRide.com and its subdomains (the “Website”) (the Application, Web, Backend Services, and the Website collectively, the “Service”) and sets out the basis on which any personal data we collect from you, or that you provide to us will be handled by us.

In this Privacy Policy, the term “personal data” means information that relates to an identified or identifiable natural person. We know that you are concerned about how we use and disclose personal data, and we are committed to complying with data protection and privacy laws that apply to us. This Privacy Policy tells you about the ways in which we protect your privacy and the personal data we process about you.

We wish to remind you that this Privacy Policy applies to personal data that we process when you use the Service. It does not apply to any third parties’ websites and/or services, such as third-party applications, that you may encounter when you use the Service. 2. Information We May Collect From You

When you use the Service, we may collect the following types of personal data from you:

a) Data You Provide to Us Directly

We collect information you provide directly to us. In particular, we may collect the following information from our users that may, in certain circumstances, constitute personal data:

  • Images and text you send for the purpose of providing feedback about the Service
  • Your email address, if you choose to subscribe to our mailing list, request support or provide feedback about the Service
  • Images, multimedia and content that are part of the settings of individual entities in applications (trips, waypoints, groups) as (“as, but not limited to”) icons, routes, timelines, descriptions, etc., are shared with other users who are part the respective activities. The specified data is stored on the server side and is not shared/forwarded to other parties unless the settings are explicitly set to be “public” or “searchable” content within the Service itself
  • Your email address, telephone number, registration name and age, if you chose to register and are of eligible age for registering a JellyRide account; and
  • Any other information you choose to provide to us or in the Service.

b) Data Collected Automatically

The Service may automatically collect the following information from you that in certain circumstances may constitute personal data:

  • Location data: We collect and process location information as constituent part of Services we provide. We do not track your device location while you are not using JellyRide and without your explicit consent while using the Service. In order to provide JellyRide’s core Services, it is necessary for us to track your device location while you are an active participant in JellyRide tracking activity that you joined with consent. If you would like to stop the device location tracking, you may do so at any time by adjusting your device or ongoing activity settings. By using the Service, you consent to way we use and manage your location information.
  • Usage data: We collect information on the ways in which you use the Service, such as how long you spend on certain parts on the Service. This information helps us understand better how people use our Service and how we can improve their user experience. Additionally, details of transactions you carry out through the Service, such as in-app purchase history, may also be collected. Such information might be stored on a device storage and sent to the Service servers.
  • Device data: We collect information about the device you use to access the Service, including for example the hardware model, operating system and version, unique device identifiers and mobile network information.
  • Images or videos taken from the camera: We may collect and use images and videos taken with your device camera through the app. This information might be used to test and improve the quality of the Service. Such information might be stored on a device storage and sent to the Service servers when your device is connected to a Wi-Fi network. Using a wi-fi network might incur additional charges.
  • Analytics technologies: Technologies such as app unique identifiers, tags and crash logs are used in the Service. We use these technologies to analyze trends, administer the Service, enable features on the Service, track users’ movements around the Service and to gather demographic information about our users. We use technology created by third parties to enable such technological features.
  • Traffic optimization and distribution: To provide a better user experience, the Service might use third-party services for traffic optimization and distribution. These service providers who automatically collect data and share it with us have their own privacy policies applicable to their operations.
  • Third party analytics providers: We may use third-party analytics services to analyze the Service on our behalf. These service providers may use app unique identifiers, tags, crash logs and other technologies to collect information about your use of the Service. These service providers enable us to collect, monitor and analyze data regarding the use of the Service, in order to understand how users use the Service and to increase the functionality and user-friendliness of the Services, as well as to better tailor the Service to users’ needs. Accordingly, some automatically collected data is shared with such third-party service providers, who have their own privacy policies applicable to their operations.   • You can choose to add your contacts’ information by connecting your contacts from your mobile device to JellyRide. If you choose to share your contacts with JellyRide, JellyRide will, in accordance with your instructions, access and store your contacts’ information in order to identify connections and help you connect with them. For the full functionality of the Service, it is necessary to add your contacts.
  • Through our Service we will be able to collect your conversation history but the information will not be processed from JellyRide nor processed or passed on to third parties outside the application solution itself. Information contained in your public social media profile, such as your name, your profile photo, your time zone, your gender, your language settings, and any other information you provide, may be used by the Service only with explicit user consent.
  • Other users of our Services with whom you choose to communicate with and share certain information, who may be located outside the EEA. Note that by entering into the Terms of Service (Terms of Service for Private UsersTerms of Service for Business Users) and choosing to communicate with such other users of JellyRide, you are instructing us to transfer your personal data, on your behalf, to those users in accordance with this Privacy Policy. We employ all appropriate technical and organizational measures (including encryption of your personal data) to ensure a level of security for your personal data that is appropriate to the risk.

3. The Purposes for Which We Use The Data

a) We use the personal data you provide to us directly for the following purposes:

  • To set up and maintain your registration with the Service, if you chose to register and if you are of legal age for registration;
  • To manage the Service;
  • To provide features available in the Service;
  • To develop, improve, and protect the Service;
  • To communicate with you;
  • To facilitate and process any in-app purchases you may make in the Service;
  • To prevent and investigate fraud and other misuses;
  • To protect our rights and/or our property;
  • To operate and improve our products and services;

  • To ensure the technical functionality and security of the Service.

In particular, please note that we use the images and feedback you send by using the Service to improve the Service and to improve our other products and services.

5. Your Rights

You have the following rights with respect to the personal data we hold about you:

  • The right to have incomplete, incorrect, outdated, or unnecessary personal data corrected, deleted or updated. The easiest way to delete, or update your data in the Service is to log in to the Service and enter the necessary changes in the account settings of the Service.   • By providing information to the Service that forms the basis of communications with you, such as contact information, you agree to receive electronic communications from us. We store information for as long as necessary for the purposes identified in this Privacy Policy, including to provide our Services or for other legitimate purposes, such as complying with legal obligations, enforcing and preventing violations of our Terms, or protecting or defending our rights, property and users. The storage periods are determined on a case-by-case basis that depends on factors like the nature of the information, why it is collected and processed, relevant legal or operational retention needs, and legal obligations.

If you would like to further manage, change, limit, or delete your information, you can do that through the following tools:

  • Services Settings. You can change your Services settings to manage certain information available to other users. You can manage your contacts, groups, and broadcast lists, or use our “block” feature to manage the users with whom you communicate.
  • Changing Your Mobile Phone Number, Profile Name And Picture, And “About” Information. If you change your mobile phone number, you must update it using our in-app change number feature and transfer your account to your new mobile phone number. You can also change your profile name, profile picture, and “about” information at any time.
  • Deleintg Your Account. You can delete your JellyRide account at any time (including if you want to revoke your consent to our use of your information pursuant to applicable law) using our in-app delete my account feature. When you delete your JellyRide account, your undelivered messages are deleted from our servers as well as any of your other information we no longer need to operate and provide our Services. Deleting your account will, for example, delete your account info and profile photo, delete you from all JellyRide groups and trips, and delete your JellyRide message history. Be mindful that if you only delete JellyRide from your device without using our in-app delete my account feature, your information will be stored with us for a longer period. Please remember that when you delete your account, it does not affect your information related to the groups and trips you created or the information other users have relating to you, such as their copy of the messages you sent them.

6. Data Security

We take reasonable measures to protect your personal data from unauthorized access or against loss, misuse, or alteration by third parties. Despite these efforts to store personal data collected in and through the Service in a secure operating environment that is not available to the public, we cannot guarantee the security of personal data during its transmission or its storage on our systems. Further, while we attempt to ensure the integrity and security of personal data, we cannot guarantee that our security measures will prevent third-parties such as so-called hackers from illegally obtaining access to personal data. We do not warrant or represent that personal data about you will be protected against, loss, misuse, or alteration by third parties.

7. International Transfers of Personal Data

Some elements of the Service may be hosted on servers located in countries outside your own country. The laws applicable to the protection of personal data in such countries may be different from those applicable in your home country. In particular, if you are located within the European Union, please note that personal data collected by us may be transferred outside the European Union / European Economic Area. You consent to personal data about you being transferred outside your own country and, where required, outside the European Union / European Economic Area.

8. Advertising

To support and enhance the Application, we may work with a variety of third party advertising networks and marketing analytics service providers such as Facebook and Google (collectively, “Third Party Advertising Service Providers”). These Third Party Advertising Service Providers collect and use personal data about your use of the mobile Application, in order to serve you with advertisements and content tailored to meet your preferences and likely interests or better understand ad effectiveness. Aggregate demographic and interest data will also be used for market research purposes.

9. Children’s Privacy

At all times the Service does not knowingly collect personal data from children under 13 (or applicable age in your country). If you learn that we have unknowingly collected personal data from a child, please contact us at [email protected].

10. Changes to the Privacy Policy

From time to time, we may modify or amend this Privacy Policy. If we do so, we will post any such modifications or changes on JellyRide Website. You can tell when changes have been made by referring to the “Last Updated” legend on top of this page. We encourage you to review the Privacy Policy whenever you access the Service to stay informed about our privacy practices. Your continued use of the Service following any changes to this Privacy Policy constitutes your acceptance of any such changes made.
